Education* | Sir John studied law at Lincoln's Inn, like his brother Henry. His branch led to the North Devon Fortescues of Filleigh and Castle Hill etc. From Chamber's Encyclopaedia published 1969: Sir John C.1394 - 1480 educated at Exeter College, Oxford, and called to the Bar at Lincoln's Inn was in 1441 made Sergeant-at-law, and in the following year Lord Chief Justice of the Court of the King's Bench. In the struggle between houses of York and Lancaster he steadily adhered to the latter and was attainted by the Parliament under Edward IV. He accompanied Margaret of Anjou and her young son, Prince Edward on their flight to Scotland and therefore is supposed to have been appointed Lord Chancellor by Henry VI. In 1463 he embarked with the Queen and her son for Holland. During his exile he wrote his celebrated work, De Laudibus Legum Angliae, for the instruction of Prince Edward who was his pupil. But on the final defeat of the Lancastrian party at the battle of Tewkesbury, 1471, where he is have been taken prisoner, Fortescue submitted to Edward IV. The De Laudibus Legum Angliae was not printed till the reign of Henry VIII; another valuable work by Fortescue is the Governance of England; otherwise called the Difference between an Absolute and a Limited Monarchy.1 |

He married in the parish of North Huish, and acquired Norreis via his wife. He had manors at Overcomb, Efford and Alsford in the parish of Holboughton or Holberton. In 1429 there is a reference to a grant by him to John Longford. He left his estate in Hertfordshire to his son Richard. in 1420.1 |

Note* | From a deed found at Eton College, found in 1885 he is named as granting land to Modbury Priory. "Richard Fortescue was summons to Assize de Morte D'Ancestre in AD 1199. He recites that his father Richard, and grandfather Radulfus (Ralph) had each granted parts of the same land to the Priory. This is proof that two generations of his predecessors held land in Modbury Parish as well as naming the succession." Clermont postulates in the 1885 supplement to chapter 1 of his 1880 edition that "Taking the year AD 1185 as the probable date of the deed and assuming that Richard was not less than 30 years old, he already being married to his wife Ysmeina, we have AD 1155 as the date of Richard's birth. 33 years being the average length of a generation. Therefore Ralph was born about 1089". Visitations to the County of Devon mentions a deed dated 1135. Whether this is the same Deed is not clear. It also has Sir Richard son of William as the person named in a deed of 1199 as married to Ysmeina. But from above this is not true.1 |

Note* | Richard went to France in 1421 or 2. He was styled as "of Ermyngton", which was where his family seat, Wympstone, was situated. No doubt he joined his father in the French wars, but he was again in Devon before 1431. At his father's death in about 1435 he succeeded to his Hertfordshire estate of Punsbourne, or Ponsbourne, or Ponnysbourne, near Hatfield. Sir Richard fought under the Duke of Somerset on King Henry VI's side in the first battle of St. Albans, which was close to his home, and was killed. Richard led to the branches at Punsbourne and Falkbourne.1 |
